TERMS OF SERVICE

Last updated: 13 September 2026

OVERVIEW

Welcome to Luxem Swiss.

This website and online store are operated by Munashe Charles, trading as Luxem Swiss.

Throughout these Terms of Service, the terms “Luxem Swiss”, “we”, “us” and “our” refer to Luxem Swiss and its operator, Munashe Charles.

Luxem Swiss operates this website and provides the information, content, features, tools, products and services available through it (collectively, the “Services”).

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services.

These Terms of Service (“Terms”) describe your rights and responsibilities when accessing or using our Services.

By visiting our website, creating an account, placing an order, purchasing a product or otherwise using our Services, you agree to these Terms together with our:

  • Privacy Policy
  • Return & Refund Policy
  • Shipping Policy
  • Cookie Policy
  • Any other policies or notices made available on our website

Please read these Terms carefully before using the Services.

If you do not agree to these Terms, you should not access or use our Services.

Nothing in these Terms limits or excludes any mandatory rights available to consumers under applicable Polish or European Union law.

SECTION 1 – ACCESS AND ACCOUNTS

By using our Services, you confirm that you are legally capable of entering into a contract under the law applicable to you.

Where a minor is permitted to use the Services, their parent or legal guardian is responsible for supervising that use where required by law.

When using our Services, you may be asked to provide information including:

  • Your name
  • Email address
  • Telephone number
  • Billing address
  • Delivery address
  • Account information
  • Payment information

You agree that information provided by you will be accurate, current and complete.

You are responsible for maintaining the confidentiality and security of your account credentials.

You should notify us promptly if you believe your account has been accessed or used without authorization.

You may not sell, transfer or assign your customer account to another person without our written permission.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizing information, pricing and other information displayed on Luxem Swiss are accurate.

However, the appearance of a product may vary slightly depending on:

  • Your device
  • Screen settings
  • Lighting
  • Manufacturing variations
  • Product photography

Such minor visual differences do not affect any statutory rights you may have where goods do not conform to the contract.

Product availability may change.

We may discontinue products or limit available quantities where reasonably necessary.

Nothing in this section limits your rights in relation to defective, damaged, incorrect or non-conforming goods.

SECTION 3 – ORDERS

When you submit an order through Luxem Swiss, you are making an offer to purchase the products contained in your order.

After placing an order, you may receive an acknowledgement confirming that we have received your order.

An acknowledgement of receipt does not necessarily mean that the order has been accepted.

A contract is formed when Luxem Swiss confirms acceptance of your order or dispatches the goods, depending on the checkout process applicable to your purchase.

We reserve the right to decline or cancel an order where there is a legitimate reason, including:

  • A product being unavailable
  • An obvious pricing or description error
  • Payment authorization failure
  • Suspected fraud or unauthorized payment activity
  • Incorrect customer or delivery information
  • Restrictions imposed by law
  • Technical errors affecting the order
  • Suspected misuse of our Services

If we cancel an order after receiving payment, any amount due to you will be refunded without undue delay.

Any statutory cancellation or withdrawal rights you have remain unaffected.

Returns and refunds are governed by our Return & Refund Policy and applicable consumer law.

SECTION 4 – PRICES AND PAYMENT

The price applicable to an order will normally be the price displayed at the time the order is placed.

Prices may change from time to time, but price changes will not normally affect orders that have already been accepted.

Where required by applicable law, prices displayed to consumers include applicable taxes.

Shipping charges and any other charges payable to Luxem Swiss will be disclosed before completion of checkout where applicable.

For international orders, customs duties, import taxes or other charges imposed by authorities outside our control may apply depending on the destination.

Where such charges are not collected by Luxem Swiss at checkout, the customer may be responsible for them where permitted by law.

We may offer:

  • Promotional prices
  • Discount codes
  • Member pricing
  • Limited-time offers
  • Other promotions

Promotions may be subject to separate conditions.

You agree to provide accurate billing and payment information.

Payment processing may be performed by third-party providers made available through our checkout.

SECTION 5 – SHIPPING AND DELIVERY

Delivery methods and estimated delivery periods are displayed through our website or checkout where applicable.

Delivery times are estimates unless a specific delivery commitment is expressly stated.

Delays may occasionally occur due to circumstances such as:

  • Carrier disruption
  • Severe weather
  • Customs procedures
  • Public holidays
  • Incorrect delivery information
  • Events outside our reasonable control

We will comply with applicable consumer law concerning delivery and delays.

For consumer purchases where Luxem Swiss arranges delivery, the risk of loss or damage to the goods generally remains with us until you, or a third party designated by you other than the carrier, physically receives the goods.

If you independently appoint a carrier that was not offered by Luxem Swiss, different rules concerning transfer of risk may apply.

Please review our Shipping Policy for additional delivery information.

SECTION 6 – RETURNS, WITHDRAWAL AND REFUNDS

Eligible consumers may have a statutory right to withdraw from an online purchase.

For eligible EU consumer purchases, this generally includes a 14-day statutory withdrawal period.

Luxem Swiss also provides a voluntary return period of up to 30 calendar days after delivery, subject to the conditions described in our Return & Refund Policy.

Our voluntary return policy does not replace or restrict statutory consumer rights.

Details concerning:

  • Withdrawal
  • Returns
  • Return shipping
  • Refunds
  • Damaged goods
  • Defective goods
  • Incorrect goods
  • Exchanges

are provided in our Return & Refund Policy.

SECTION 7 – PRODUCT CONFORMITY AND CONSUMER RIGHTS

Products supplied to consumers must conform to the applicable sales contract as required by law.

If a product is defective, damaged, incorrect or otherwise does not conform to the contract, you may have statutory remedies.

Depending on the circumstances and applicable law, these may include:

  • Repair
  • Replacement
  • Price reduction
  • Withdrawal from the contract

Nothing in these Terms excludes or restricts rights that cannot legally be excluded or restricted.

SECTION 8 – INTELLECTUAL PROPERTY

Unless otherwise indicated, the Luxem Swiss website and its original content are owned by, licensed to or lawfully used by Luxem Swiss.

This may include:

  • The Luxem Swiss name
  • Logos
  • Branding
  • Website design
  • Graphics
  • Original photographs
  • Videos
  • Written content
  • Software elements
  • Product presentations
  • Original marketing materials

Third-party trademarks, product names, photographs and other intellectual property remain the property of their respective owners.

You may use our Services for lawful personal and non-commercial purposes.

Unless permitted by law or expressly authorized by us, you may not reproduce, distribute, republish, modify, commercially exploit or create derivative works from proprietary Luxem Swiss content.

Nothing in these Terms transfers ownership of intellectual property to you.

SECTION 9 – OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, applications or services operated by third parties.

These may include:

  • Payment providers
  • Delivery services
  • Product review services
  • Customer account tools
  • Analytics providers
  • Wishlist services
  • Financing or buy-now-pay-later services

We do not necessarily control third-party services.

Your use of a third-party service may also be governed by that provider's terms and privacy policies.

Nothing in this section excludes responsibility where Luxem Swiss remains legally responsible under mandatory law.

SECTION 10 – THIRD-PARTY LINKS

Our Services may contain links to websites or resources operated by third parties.

We are not responsible for the content or operation of third-party websites that we do not control.

Before entering into a transaction with a third party, you should review that third party's applicable terms and policies.

Complaints relating solely to products or services purchased directly from an independent third party should normally be directed to that third party.

SECTION 11 – RELATIONSHIP WITH SHOPIFY

Luxem Swiss is powered by Shopify, which provides technology used to operate our online store.

Purchases made from Luxem Swiss are transactions between the customer and Luxem Swiss, not between the customer and Shopify.

Shopify may process information required to operate the e-commerce platform, checkout, security and related functionality.

The processing of personal information is further explained in our Privacy Policy and Shopify's applicable privacy documentation.

SECTION 12 – PRIVACY AND PERSONAL INFORMATION

Personal information collected through the Services is processed in accordance with our Privacy Policy and applicable data-protection law.

Depending on the circumstances, personal information may be processed by Luxem Swiss and service providers including:

  • Shopify
  • Payment providers
  • Delivery companies
  • Fulfilment partners
  • Analytics providers
  • Advertising providers
  • Customer-support providers
  • Fraud-prevention providers

Please review our Privacy Policy for more information about:

  • What information we collect
  • Why we process it
  • Legal bases for processing
  • Data retention
  • International transfers
  • Your GDPR rights
  • How to contact us about your personal information

SECTION 13 – FEEDBACK, REVIEWS AND SUBMISSIONS

You may choose to submit:

  • Product reviews
  • Comments
  • Suggestions
  • Photographs
  • Feedback
  • Other content

You confirm that you have the necessary rights to content you submit.

You must not submit content that:

  • Is unlawful
  • Infringes another person's intellectual property rights
  • Violates privacy rights
  • Is fraudulent or deliberately misleading
  • Contains malicious software
  • Is defamatory or unlawfully abusive

Where you submit content for publication, you grant Luxem Swiss the rights reasonably necessary to display, reproduce and use that content in connection with operating and promoting our Services, subject to applicable law.

Where legally required, sponsored or incentivized reviews must be appropriately disclosed.

SECTION 14 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, our Services may contain errors or omissions concerning:

  • Product descriptions
  • Pricing
  • Promotions
  • Availability
  • Shipping
  • Delivery estimates
  • Product specifications

We reserve the right to correct errors and update information.

Where an error affects an order already placed, we will handle the matter in accordance with applicable consumer law.

An obvious error does not automatically require us to supply a product on terms that a reasonable customer would recognize as clearly incorrect, subject to applicable law.

SECTION 15 – PROHIBITED USES

You may use our Services only for lawful purposes.

You must not use the Services to:

  • Commit or facilitate unlawful activity
  • Commit fraud
  • Infringe intellectual property rights
  • Submit deliberately false or misleading information
  • Transmit viruses, malware or harmful code
  • Attempt unauthorized access to accounts or systems
  • Circumvent website security
  • Harvest personal information unlawfully
  • Conduct unlawful scraping or data collection
  • Spam or conduct phishing activity
  • Impersonate another person
  • Interfere with the normal operation of our website
  • Abuse our checkout, payment or promotional systems

We may suspend or restrict access where reasonably necessary to protect Luxem Swiss, our customers, our systems or third parties.

SECTION 16 – AUTOMATED SYSTEMS AND AGENTS

Automated systems, bots or software agents must not access or interact with the Services in a manner that:

  • Circumvents technical security measures
  • Attempts to bypass CAPTCHAs or access controls
  • Conceals malicious automated activity
  • Creates unreasonable loads on our systems
  • Scrapes protected information unlawfully
  • Attempts unauthorized purchases or account access
  • Interferes with the normal operation of the Services

We may use reasonable technical measures to restrict abusive or unauthorized automated access.

This section does not prohibit legitimate search engines, accessibility tools or other lawful automated services operating in accordance with applicable rules and technical instructions.

SECTION 17 – TERMINATION OR SUSPENSION

You may stop using the Services at any time.

We may restrict or suspend access to accounts or Services where reasonably necessary because of:

  • A material breach of these Terms
  • Fraud or suspected fraud
  • Unauthorized activity
  • Security concerns
  • Legal requirements
  • Abuse of our Services

Termination does not affect rights or obligations that arose before termination.

Consumer rights relating to purchases already made remain unaffected.

SECTION 18 – DISCLAIMER OF WARRANTIES

We aim to provide reliable and secure Services, but we cannot guarantee that our website will always operate without interruption or technical error.

The Services may occasionally be unavailable due to:

  • Maintenance
  • Security measures
  • Technical failures
  • Infrastructure problems
  • Circumstances outside our reasonable control

Nothing in these Terms excludes, restricts or replaces any statutory warranty, guarantee, conformity requirement or consumer remedy that applies by law.

SECTION 19 – LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Luxem Swiss will not be responsible for losses that:

  • Were not reasonably foreseeable when the contract was made
  • Result from circumstances outside our reasonable control
  • Arise from unlawful or unauthorized use of the Services
  • Are purely commercial losses suffered by a person acting for business purposes

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms limits mandatory consumer protection rights.

SECTION 20 – INDEMNIFICATION

Where permitted by applicable law, a user may be responsible for losses or claims directly caused by that user's unlawful misuse of the Services, material breach of these Terms or infringement of third-party rights.

This section does not impose liability on consumers beyond what is permitted under applicable law.

SECTION 21 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.

Where possible, the remaining provisions will continue to apply.

SECTION 22 – WAIVER AND ENTIRE AGREEMENT

If Luxem Swiss does not immediately enforce a right under these Terms, this does not necessarily mean that the right has been waived.

These Terms together with the policies incorporated or referenced by them form the agreement governing your use of the Services.

Nothing in this section prevents consumers from relying on rights granted by mandatory law.

SECTION 23 – ASSIGNMENT

You may not transfer contractual rights or obligations to another person where such transfer is prohibited by law or would materially affect Luxem Swiss without our consent.

Luxem Swiss may reorganize or transfer parts of its business where legally permitted.

Any transfer affecting a consumer contract will not reduce the consumer's mandatory rights.

SECTION 24 – GOVERNING LAW

These Terms and contracts entered into with Luxem Swiss are governed by the laws of Poland, subject to applicable European Union law.

If you are a consumer residing in another country, this choice of Polish law does not deprive you of mandatory consumer protections that would otherwise apply to you under the law of your habitual residence.

Nothing in these Terms requires a consumer to give up a right to bring proceedings before a court that has jurisdiction under applicable law.

SECTION 25 – CHANGES TO THESE TERMS

The current version of these Terms will be available on this page.

We may update these Terms where reasonably necessary, including because of:

  • Changes to our Services
  • Changes to law or regulation
  • Security requirements
  • Technical developments
  • Changes to our business operations

Material changes will be communicated where required by applicable law.

Changes will not retrospectively remove statutory rights relating to orders already concluded.
